The Board of County Commissioners met as a Board of Canvassers to review the votes cast at the Primary Election held on August 3, 2010. Since Commissioner, Madison Traster, was absent, Commissioners, Carl Higgs and Marty Long, appointed Mary K. Sullivan, Register of Deeds, as the third canvasser.
Sandra Widder and Dan Widder, Candidate for the 124th State Representative position, attended the canvas.
No discrepancies were found in the tallies made at the original canvass. After processing the provisional ballots, it was determined that there was a tie between Carl Higgs and John Battin for the Commissioner District 1 race.
A call to the Secretary of State's office instructed that pursuant to K.S.A. 25-3108, the winner would be determined by lot. The decision was made to meet in the commissioners' room at the courthouse on August 8, 2010, at 6:00 p.m. to allow both candidates the opportunity to witness the resolution of the tie.

The Board of Canvassers met at 6:00 p.m. to determine the winner of the Commissioner District 1 race. Marty Long decided the determination would be made by flipping a coin, with Mary K. Sullivan flipping the coin, and Candidate Carl Higgs calling it while the coin was in the air. Candidate Higgs called heads, and was successful in retaining his seat on the commission.
